FamilyMint Privacy Policy

This Privacy Policy (the “Policy”) sets forth FamilyMint, Inc.’s (“FamilyMint”, “Company”, “I” or “we”) policies regarding the collection and use of information relating to the FamilyMint website www.familymint.com (the “Web Site”) accessible for use by users who visit the Web Site (“Visitors”). Your use of the Web Site is contingent and predicated upon your acceptance of the terms of this Policy.  If you do not accept the terms of this Policy, you may not use the Web Site.

INFORMATION COLLECTION AND USE

General

Visitors understand and agree that we may collect, maintain, and process information provided by Visitors, on and through the Web Site.  If you elect to contribute information, you represent that it is accurate, current, non-misleading, and consistent and relevant for the purpose for which such information is provided.

Public Areas of the Web Site

Visitors may visit areas of the Web Site without disclosing any personal information about them.  However, Visitors will have the opportunity to send information to us and to request to receive information from us, in which case an e-mail, address or other information may be required in order to allow us to comply with the request, and for other purposes as may be disclosed at the time the request is made.  Visitors may elect to opt-out from receiving materials from us by following the instructions in OPT-OUT CHOICES, below or as set forth in the communication sent from us.

Collected Information

In order to register for the services offered, we require Visitors to provide certain contact and other information (“Information”). We use this Information to confirm your identity, provide services, and communicate with Visitors regarding the services, available features and other activities relating to the Web Site.   Instructions on how to request no future communications from us are set forth in OPT-OUT CHOICES, below.

Upon registration, you will receive a series of email communication designed to address your questions and make your experience positive in using the Web Site.  These communications may include a welcome letter, tips, enrollment in a newsletter, and other material.

FamilyMint is the sole owner of the information collected on FamilyMint.com. FamilyMint collects personally identifiable information from our users at several different points on our Web site.

Protecting Children’s Information Online

The Children's Online Privacy Protection Act of 1998 (COPPA) restricts the disclosure and use of Personal Information of children who are under the age of 13 (a "Child").  Users are required to register with us before we collect any Personal Information. Users under the age of 13 must have a parent or guardian register and create a profile with us for their Child to use. By using FamilyMint as a parent or guardian, you warrant and represent that you have sufficient legal authority to act on behalf of any Child for whom you create a FamilyMint profile and you consent to the collection of information about the Child as described herein.

If your Child has submitted Personal Information, you may review the Personal Information at any time by accessing your Child’s profile.  You may update or modify such information at any time.  You may request that we delete all Personal Information about your child by contacting us via one of the contact methods described in this Policy.

Usage Data

We may record and collect information about how Visitors use the Web Site.  This data may include a Visitor’s domain name, language, type of browser and operating system, Internet Service Provider, Internet protocol (IP) address, the Web site from which they arrived at the Web Site, and the amount of time spent on the Web Site (collectively, “Usage Data”).  We will monitor and use Usage Data to measure the Web Site’s performance and activity and improve the Web Site’s design and functionality.

Cookies

As with many state-of-the-art Internet sites, we may use “cookies” to, among other things, enhance the functionality of the Web Site and to make transactions and other activities through the Web Site more convenient and efficient for Visitors.  A “cookie” is a file stored locally on a user’s computer.  Most Internet browsers include preference settings that allow users to be notified and control whether cookies are transferred to their computers.

Surveys or Contests

From time-to-time we may provide you the opportunity to participate in contests or surveys on our site.  If you participate, we will request certain personally identifiable information from you. Participation in these surveys or contests is completely voluntary and you therefore have a choice whether or not to disclose this information.  The requested information typically includes contact information (such as name and shipping address) and demographic information (such as zip code).  This information may be added to existing Private Information.  We use this information to notify contest winners and award prizes, personalize the site or to send participants an email  newsletter or additional information.

Tell-A-Friend

If you choose to use our referral service to tell a friend about our site, we will ask you for your friend’s name and email address.  We will automatically send your friend a one-time email inviting him or her to visit the site.  FamilyMint stores this information for the sole purpose of sending this one-time email and tracking the success of our referral program.  Your friend may contact us at support@familymint.com to request that we remove this information from our database.

We will occasionally send you information on products, services, and promotions,  You can sign up or opt-out of these emails from us.  Please see the “Opt-out Choices” section.

Newsletters

If you wish to subscribe to our newsletter(s), we will use your name and email address to send the newsletter to you.  Out of respect for your privacy, we provide you a way to unsubscribe.  Please see the “Opt-out Choices” section.

Service-related Announcements

We will send you strictly service-related announcements on rare occasions when it is necessary to do so.  For instance, if our service is temporarily suspended for maintenance, we might send you an email.  Generally, you may not opt-out of these communications, which are not promotional in nature.  If you do not wish to receive them, you have the option to deactivate your account by sending an email to support@familymint.com.

Customer Service

Based upon the personally identifiable information you provide us, we will send you a welcoming email to verify your username and password.  We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your account. We will communicate with you by email or telephone, in accordance with your wishes.

Vendors

We may share your personal information with companies acting as our authorized agents in providing our service (e.g., credit card processing, customer/support services) to you, all of which agree to use it only for such specified purposes.  Each vendor must agree to implement and maintain reasonable security procedures and practices appropriate to the nature of your information in order to protect your personal information from unauthorized access, destruction, use, modification or disclosure.

Partners and Sponsors

We may share your personal information with companies acting as partners or sponsors of our service (e.g. organizations paying all or a portion of the subscription fee on your behalf) to you, all of which agree to use it only for such specified purposes.  Each partner or sponsor must agree to implement and maintain reasonable security procedures and practices appropriate to the nature of your information in order to protect your personal information from unauthorized access, destruction, use, modification or disclosure.

Legally affiliated entities

In the even

t that FamilyMint is merged, or in the event of a transfer of our assets, Web Site or operations, FamilyMint may disclose or transfer your personal information in connection with such transaction.  In the event of such a transfer, FamilyMint will notify you via email or by posting a prominent notice on our Web Site for 30 days of any such change in ownership of FamilyMint resulting in a change of control of your personal information.

Consent to processing

By providing any personal information to us, you fully understand and unambiguously consent to the transfer of such personal information to, and the collection and processing of such personal information in the United States and other countries or territories.  Your personal information will be stored and processed on our computers in the United States. The laws on holding personal information in the United States may vary and be less stringent than laws of your state or country.  We will use commercially reasonable efforts to hold and transmit your personal information in a safe, confidential and secure environment.  If you object to your personal information being transferred or used in this manner please do not register with or use the Web Site.

OPT-OUT CHOICES

To “opt-out” of any consents previously given to us or receiving communications from us, follow the instructions included in each newsletter or communication or email us at support@familymint.com with “Unsubscribe” in the subject line. Notwithstanding this right to request to cease receiving communications from us and to have us not share personal information with third parties, we retain the right to collect, maintain and process information provided by and collected about Visitors on and through the Web Site, and disclose such information to comply with its reasonable business and legal obligations.

ACCESS TO PERSONAL INFORMATION

To the extent that Visitors may provide personal information to us on or through the Web Site, we will allow reasonable access to, and review of, such information, where such information is readily available, upon proper verification and authentication of the person (author) seeking such access and review.    Changes or corrections to personal information may be made by signing into your profile and updating your information.

We may provide links to third parties’ Web sites (“Linked Sites”).  Linked Sites are not reviewed, controlled or examined by us in any way and we are not responsible for the privacy policies and practices of any such Linked Sites, or any additional links contained therein.  These links do not imply our endorsement of or association with the Linked Sites.

LEGALLY COMPELLED DISCLOSURE

We will disclose your personal information when required to do so by law, for example, in response to a court order or a subpoena or other legal obligation, in response to a law enforcement agency's request, or in special cases when we have reason to believe that disclosing your personal information is necessary to identify, contact or bring legal action against someone who may be causing injury to or interference with (whether intentionally or unintentionally) our rights or property.

We follow generally accepted industry standards to protect the personal information submitted to us, both during transmission and once we receive it.  No method of transmission over the Internet, or method of electronic storage, is 100% secure, however.  Therefore, while we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

UPDATES TO THE PRIVACY POLICY

We may update this Policy at any time, by posting the amended Policy on the Web Site.  The revised or amended Policy shall automatically be effective after it is initially posted on the Web Site.  Any access to or use of the Web Site following such update shall be deemed consent to such update. Visitors are therefore encouraged to refer back to this page regularly.  This Policy may not be otherwise amended without our written consent.
